STRUCTURE AND MECHANISM OF CORPORATE GOVERNANCE

  1. The Company guarantees the interests and provides legal assistance to the whistleblower before and after the completion of the case process related to the reported matter; and
  2. The Company grants the right to the whistleblower to participate in the process of selecting and determining the form of interest protection and legal assistance as long as does not conflict with company regulations.

COMPLAINT HANDLING

  1. A report can be followed up if the following criteria is fulfilled:
    1. Included in the criteria for the types of violations as have been determined;
    2. The report is an act of violation involving Pelindo People;
    3. The report has an impact on the performance and reputation of PT Pelabuhan Indonesia (Persero); and
    4. The management of PT Pelabuhan Indonesia (Persero) will prioritize the follow-up to the report submitted by the Whistleblower that is stating his/her identity and equipped with 2 (two) supporting evidences.
  2. The requirements for the report submitted should at least contain the following:
    1. Whistleblower Identity;
      The Whistleblower must state his/her identity so that the Whistleblower can get protection from the management of PT Pelabuhan Indonesia (Persero) and will facilitate the follow-up of the report if additional data is required. The whistleblower may not include an identity (anonymous) but for the purposes of report verification, the whistleblower's identity is required.
    2. The description of violation committed in the report shall at least contain:
      • Problem: The reported violation is a violation related to the activities of the company and or its subsidiaries;
      • Incident location; and
      • Incident time.
    3. Data of the reported and other parties involved and their units (if any);
    4. Supporting documents and/or other evidence; dan
    5. Complaints that will be further processed are incidents/events that occurred within the last 3 (three) years from the receipt date of the report by Pelindo Bersih Committee.
  3. The evidence as referred to in point 3.b.4 includes, but is not limited to the following:
    1. Written evidence in the form of Documents, letters, receipts or billing notes that are written on paper or in the form of data or electronic letter that can be read and legally proven;
    2. Unwritten Evidence in the form of witnesses, Sound Recordings (Audio), Visual Recordings or pictures (video); and
    3. Other evidence in accordance with applicable regulations;
